These terms govern how you can use echooos and what applies to the optional Echooos Unlimited subscription. They apply to both the app and the website.

Scope

These Terms of Service govern your use of the echooos app and the echooos website. The provider and your contracting party are the operators named in the imprint (Marcel Bartling and Bastian Schmalbach); the full address and contact details are set out in the imprint. By registering for or using the app or website, you agree to these terms. The rules of the respective app stores apply in addition: when you use the app on iOS devices, Apple's standard Licensed Application End User License Agreement (EULA) applies additionally wherever these terms are silent; in case of conflict, these terms prevail to the extent legally permitted. Mandatory consumer protection provisions remain unaffected.

The service

echooos is a private social game for groups of friends. In shared rounds you assign facets to one another and receive results and insights about how you see yourself and how others perceive you. The service comprises the app, its server-side functionality, and the website. The specific feature set may evolve over time.

Account and minimum age

Using the core features requires an account; you sign in through the sign-in methods offered in the app. echooos is intended for people aged 16 and older; younger people may not use the service. You agree to provide accurate information when registering and to keep your profile up to date. Keep your credentials safe and do not share them with third parties; you are responsible for activity that takes place through your account. If you have any indication that your account is being used without authorization, let us know via the support page.

Echooos Unlimited

Echooos Unlimited is an optional, paid subscription that unlocks additional features — such as extra rerolls, full access to insights, the complete results view, and full facet browsing. The exact scope of Echooos Unlimited may evolve; the core features of echooos remain usable without a subscription. The subscription is purchased and billed exclusively through your Apple App Store or Google Play account; no separate payment-processing contract is concluded with us. Echooos Unlimited is offered with different billing periods (for example monthly or annual), and new subscribers may be offered a free trial; the applicable price, billing period, and any trial are shown to you before purchase in the app store's checkout.

Term, renewal and cancellation

The Echooos Unlimited subscription renews automatically for a further period of the same length unless you cancel it at least 24 hours before the end of the current period. If the subscription begins with a free trial, it converts into a paid subscription at the end of the trial unless you cancel at least 24 hours before the trial ends. You can manage and cancel the subscription at any time in the subscription settings of your Apple or Google account; we ourselves cannot cancel a subscription concluded through the stores. Simply deleting the app does not cancel a running subscription. After cancellation, the subscription features remain available until the end of the period you have already paid for.

Prices and payment

The price, billing period, and any introductory offers are shown to you before purchase in the app store and charged to the payment method stored there. Refunds are governed by Apple's or Google's policies and handled by them; please contact the relevant store for refunds. As a consumer in the EU, you generally have a 14-day right of withdrawal for digital content. When purchasing through the app stores, you exercise this right of withdrawal towards Apple or Google. The statutory right of withdrawal can expire early where we begin performance after you have expressly consented and acknowledged that you lose your right of withdrawal once performance begins (§ 356(5) of the German Civil Code, BGB).

Acceptable use and content

For content you submit within the app's features — such as profile and group images, group names, answers, or reactions — you grant echooos a simple, non-exclusive right to store, host, and display that content to the extent technically necessary and within the app's function, so the service can deliver the intended results to you and your group. All other rights in your content remain with you. Prohibited in particular are: posting unlawful content, harassing or threatening others, impersonating another person, abusing the service, reverse engineering the app except where permitted by law, and automated scraping of content. If you encounter content or behavior that violates these terms, you can report the person in the app and block them; reports are reviewed by us. In the event of violations, we may remove the affected content and take measures under the "Termination and suspension" section.

Availability and changes

We provide the service with reasonable care but cannot guarantee uninterrupted or error-free availability; maintenance, disruptions, or adjustments may cause temporary limitations. We may further develop, change, or discontinue features. Changes to the Echooos Unlimited features do not affect the core of what you have paid for within a period you have already paid for.

Liability

We are liable without limitation for intent and gross negligence, for injury to life, body, or health, and in cases of mandatory statutory liability, in particular under the German Product Liability Act (Produkthaftungsgesetz). In the case of slight negligence, we are liable only for the breach of an essential contractual obligation (a "cardinal obligation") — that is, an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you regularly rely; in that case, liability is limited to the foreseeable damage typical for this type of contract. Any further liability is excluded. Mandatory statutory rights, in particular consumer rights, remain unaffected.

Termination and suspension

You can delete your account in the app at any time and thereby end your use. We may temporarily suspend access or terminate the usage relationship if you materially breach these terms or if this is necessary for good cause. For paid subscription periods, the rules in the "Echooos Unlimited" section apply; subscriptions concluded through the app stores are managed and cancelled in the subscription settings of the respective store.

Changes to these terms

We may adjust these Terms of Service for legitimate reasons, for example due to changes in the legal situation, case law, or the feature set. We will notify you of material changes in an appropriate manner, for example in the app or by notice. If you continue to use the service after a change takes effect, this counts as acceptance to the extent legally permitted; otherwise, use remains possible on the basis of the previous terms until any required consent is given.

Final provisions

German law applies; mandatory consumer protection provisions of the country of your habitual residence remain unaffected. The European Commission provides a platform for online dispute resolution (ODR) at https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 of the German Act on Alternative Dispute Resolution in Consumer Matters, VSBG).
